License America Vid Affiliate Program Agreement

1. General Information

This Agreement contains the full terms and conditions that apply for you to become an affiliate in the licenseamericavideo.com Affiliate Program. The purpose of this Agreement is to allow HTML links between your website and the licenseamericavideo.com website. Please note that throughout this Agreement, “we”, “we” and “our” refer to licenseamericavideo.com, and “you”, “your” and “yours” refer to the affiliate.

2. Obligations of the affiliate

2.1 To begin the enrollment process, you will complete and submit the online application on the license to [email protected]. Just because we automatically approve requests doesn’t mean we can’t reassess your request later. We may deny your request at our sole discretion. We may cancel your request if we determine that your site is not eligible for our Program, even if:

2.1.3 Promotes discrimination based on race, sex, religion, national origin, disability, sexual orientation, or age.
2.1.4 Promote illegal activities.
2.1.5 Incorporate any material that infringes or helps others to infringe any copyright, trademark or other intellectual property rights or violate the law.
2.1.6 Includes “LicenseAmericaVid”, variations or spelling of the same in your domain name or your product names: License America Videos Company, License America Stogram, License America Music, License AV Video to MP3, License AV Slideshow Maker and names of any future applications.
2.1.7 In any other way it is illegal, harmful, threatening, defamatory, obscene, harassing or racial, ethnic or otherwise objectionable to us in our sole discretion.
2.1.8 Contains software downloads that potentially allow commission deviations from other affiliates in our program.
2.1.9 You may not create or design your website or any other website that operates, explicitly or implicitly, in a way that resembles our website, or design your website in a way that makes customers believe you are licenseamericavideo. com or any other business affiliate.

2.2 licenseamericavideo.com reserves the right, at any time, to review your location and approve the use of Your links and require that you change the location or use to comply with the guidelines provided.

2.3 The maintenance and updating of your software will be your responsibility. We may monitor your site when we deem it necessary to ensure that it is up to date and notify you of any changes that we believe should improve its performance.

3. Rights and obligations of licenseamericavideo.com

3.1 We have the right to monitor your site at any time to determine if you are following the terms and conditions of this Agreement. We may notify you of any changes to your site that we believe should be made, or to ensure that your links to our servers are appropriate and to further notify you of any changes that we believe should be made. If you do not make changes to your site that we deem necessary, we reserve the right to terminate your participation in the licenseamericavideo.com Program.

3.2 licenseamericavideo.com reserves the right to terminate this Agreement and your participation in the licenseamericavideo.com Affiliate Business Program immediately and without notice if you commit fraud or abuse of the licenseamericavideo.com Affiliate Program program in some way. If such fraud or abuse is detected, licenseamericavideo.com will not be liable to you for any commission for such fraudulent sales. Including that you copy video material on any Hard Drive, USB, CD-Room and use it in any other business where you did not send the registration.

3.3 This Agreement will begin when we accept your Affiliate application, and will continue unless terminated below.

4. Termination

You or we may terminate this Agreement AT ANY TIME, with or without cause, by written notification to the other party. The written notice may be in the form of mail, email or fax. Furthermore, this Agreement will terminate immediately in the event of default by you.

5. Modification

We may modify any of the terms and conditions of this Agreement at any time at our sole discretion. In such a case, you will be notified by email. Modifications may include, but are not limited to, changes to payment procedures and licenseamericavideos.com Affiliate Program rules. If any modification is unacceptable to you, your only option is to terminate this Agreement. Your continued participation in the licenseamericavideo.com Affiliate Program after the publication of the notice of change or the new Agreement will be notified from our general email [email protected].

6. Payment

License America Vid uses a third party to handle all tracking and payment. The third is the Paypal platform. Payment will be made in USD currency through Paypal, posted 30 days after customer payment, the minimum amount is 649.99 USD.

7. Access to the affiliate account interface

It will create a password to enter the secure interface of the payment account via Paypal. From your Paypal account you can receive your reports that will describe our calculation of the commissions that are due. Payment receipts will arrive and must be covered within a period not exceeding 2 days from the court day.

8. Promotion restrictions

8.1 You are free to promote your own Videowalls, Projectors, LED Screens, Restauranet, Bar, Nightclub but, of course, any promotion that mentions licenseamericavideo.com and its products could be perceived by the public or the press as a joint effort. You should know that licenseamericavideo.com always prohibits certain forms of advertising. For example, advertising commonly known as “spam” is unacceptable to us and could harm our name. Other generally prohibited forms of advertising include the use of Unsolicited Commercial Email (UCE), posting to non-commercial newsgroups, and cross-posting to multiple newsgroups at once. Additionally, you cannot advertise in any way that effectively conceals or misrepresents your identity, domain name, or return email address. You can use emails to customers to promote licenseamericavideo.com as long as the recipient is either a customer or subscriber of your services or company, and the recipients have the option to remove themselves from future emails. Additionally, you can post to newsgroups to promote licenseamericavideo.com as long as the newsgroup specifically welcomes commercial messages. At all times, you must clearly represent yourself and your business as independent from licenseamericavideo.com. If it becomes known to you that you are sending spam, we will consider that cause for the immediate termination of this Agreement and your participation in the licenseamericavideo.com Affiliate Business Program. The balances paid will not be returned, you could request the bonus for months paid and there must be a cause of force majeure to accept from us the license bonus in subsequent months.

8.2 Affiliates who, among other actions, do not direct the traffic of said campaigns to their own business before redirecting it to ours, will be considered a trademark infringer and will be prohibited from the licenseamericavideo Affiliate Program. We will do our best to contact the affiliate before the ban. However, we reserve the right to remove any trademark infringer from our affiliate program without notice, and in the first instance of such PPC bid behavior.

8.3 Affiliates are not prohibited from entering prospect information on the prospect form as long as the prospect information is real and true, and these are valid prospects (i.e. sincerely interested in the License America service Video).

9. Disclaimer

LICENSEAMERICAVIDEO.COM MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE LICENSEAMERICAVIDEO.COM SERVICE AND THE WEBSITE OR THE PRODUCTS OR SERVICES PROVIDED BY THE SAME, YEURY, PARTICIPANTS, OR EXCEPT EXCLUDED FURTHER, WE MAKE NO REPRESENTATION THAT THE OPERATION OF OUR SITE WILL BE UNINTERRUPTED OR ERROR-FREE, AND WE WILL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTION OR ERROR.

10. Limitations of liability

SHALL NOT BE LIABLE TO YOU WITH RESPECT TO ANY ISSUE OF THIS AGREEMENT UNDER ANY CONTRACT, NEGLIGENCE, TORT, STRICT LIABILITY, OR OTHER LEGAL OR EQUITABLE THEORY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPT DAMAGES. OR GOOD WILL OR ANTICIPATED EARNINGS OR LOSS OF BUSINESS), EVEN IF WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. IN ADDITION, WITHOUT ANYTHING TO THE CONTRARY CONTAINED IN THIS AGREEMENT, IN NO EVENT SHALL LICENSEAMERICAVIDEO.COM’S CUMULATIVE LIABILITY TO YOU ARISE FROM THIS AGREEMENT, WHETHER BASED ON CONTRACT, NEGLIGENCE, STRICT LIABILITY, TORT OR OTHER OF THE COMMISSION PAID UNDER THIS AGREEMENT.
